Vlastnictví bytů a nebytových prostor

Abstract

Problematika bytového vlastnictví a vlastnictví nebytových prostor se stala předmětem zájmu a zkoumání autorky disertační práce z více důvodů. Především se jedná o významný společenský fenomén dnešní doby, přičemž z důvodů zcela logických, tedy že práce je závěrečnou prací doktorandky Právnické fakulty Univerzity Karlovy v Praze, zaměřuje se na aspekty právní, přestože o tématu by mohlo být podobně podrobně pojednáno i z hlediska sociologického, ekonomického apod. Cílem této disertační práce je podat podrobné informace získané detailní analýzou platné právní úpravy bytového vlastnictví. Badatelským záměrem bylo hledání odpovědi na otázku, zda bytové vlastnictví tak, jak je legislativně zakotveno, může zajistit odpovídajícím způsobem uspokojování bytových potřeb většiny občanů ČR. Jak je ze závěru práce zřejmé, právní úprava byla vyhodnocena jako funkční. Přes všechna problematická místa, zvláště navzdory nedostatečné či nejasné zákonné úpravě, obstojí poměrně dobře i ve srovnání se zahraničními právními úpravami. Přesto autorka textu upozorňuje na mnohá její úskalí, která přinášejí aplikační obtíže. The problems of ownership of flats and ownership of non-residential space became the subject of interest and research of the author of this dissertation for a number of reasons. First of all, it is an important social phenomenon of the present, but - for fully logical reasons, the study is the final work of the doctoral student of the Faculty of Law of Charles University in Prague - the thesis focuses on legal aspects, although the topic might be similarly studied in detail from the views of sociology, economy etc. The aim of this thesis is to give extensive information obtained by detail analysis of the valid legal regulation of ownership of flats. The research intention was to search for an answer to the question whether the ownership of flats, as it is embodied in legislation, can provide in an adequate manner the satisfaction of housing needs of the majority of citizens of the Czech Republic. From the conclusions of the thesis it is evident that the legal regulation has been evaluated as functional. Despite all problematic places, especially in spite of the insufficient or unclear legal regulation, it can stand up even in comparison with legal regulations of other countries.
