Abstract

74 Shrnutí v českém jazyce Název práce: Práva cestujícího v letecké dopravě Práce se zabývá právní úpravou regulující práva cestujícího v letecké dopravě, včetně obecné úpravy uzavřené smlouvy o přepravě a praktických možností cestujícího svá práva v konkrétních situacích uplatnit. Kromě právní úpravy tvoří podstatnou část této práce rovněž judikatura, a to nejen českých soudů, ale zejména Soudního dvora Evropské unie a v menší míře též soudů německých. V rámci práce dochází postupně k analýze a identifikaci právní úpravy (v úseku smlouvy o přepravě v komparaci s právní úpravou v německém právním řádu), stanovení jejích problematických aspektů a v rámci úvah de lege ferenda k předložení možností jejich řešení. Hlavním cílem práce je komplexní zpracování aktuálních praktických i teoretických témat "přepravního práva" s akcentem na leteckou přepravu osob a poté analýza a systematické zařazení konkrétních práv cestujícího v jednotlivých souvislostech. Práce se dělí na úvod, čtyři kapitoly, členící se na další subkapitoly, a závěr, přičemž v první kapitole dochází k definici pro oblast "přepravního práva" zásadních pojmů, kategorizace přepravy a právní úpravy pro oblast vnitrostátní, mezinárodní a unijní letecké přepravy osob. 75 Resume in English Name of the thesis: Rights of passengers in air transport The thesis deals with the legal regulation regarding the rights of the passenger in air transport, including the general regulation of the concluded contract of carriage and the practical possibilities of a passengers to apply their rights in specific situations. In addition to the legal regulation, a significant part of this work represents the judicature not only of Czech courts, but also of the Court of Justice of the European Union, and to a lesser extent, of German courts. In terms of the thesis, the legal regulation is analyzed and identified (in the rage of contract of carriage also comparised with the German legal order), and its problematic aspects are determined and de lege ferenda are presented possibilities for their solution. The main aim of the thesis is to elaborate the current practical and theoretical themes of "transport law" with emphasis on the person's air transport and then to analyze and systematically include concrete rights of a passenger in individual contexts.
