Problematika transparentního zadávání veřejných zakázek v České republice

Abstract

This qualitative case study focused on transparent public procurement. In the first three parts, the entire procurement process as well as the economic, legal and public policy definition were described through document analysis and secondary data analysis. The issue of the transparent behavior of the contracting authorities and the publication of relevant information was assessed more in detail. This fullfill the first secondary goal of the thesis - to describe the entire tender process and describe the transparent behavior associated with public procurement. The fourth part focuses on secondary analysis of data on the theoretical anchoring of the phenomenon. In the fifth part, the research analyzes the behavior of 12 selected public contracting authorities and tenderers using the mentioned qualitative methods. The answers of respondents are compared using tables and diagrams as well as the theoretical background. Tato kvalitativní případová studie je zaměřena na transparentní zadávání veřejných zakázek. V prvních třech částech je pomocí analýzy dokumentů a sekundární analýzy dat popsán celý proces zadávání veřejných zakázek a také ekonomické, právní a veřejně politické vymezení. Detailněji je rozebrána problematika průhledného chování veřejných zadavatelů a zveřejňování příslušných informací. Tím je naplněn první vedlejší cíl práce - popsat proces celé veřejné soutěže a popsat průhledné chování spojené se zadáváním veřejných zakázek. Čtvrtá část je zaměřena sekundární analýzou dat na teoretické ukotvení daného fenoménu. V páté části výzkum analyzuje chování pomocí zmíněných kvalitativních metod 12 vybraných veřejných zadavatelů a uchazečů o veřejné zakázky. Odpovědi respondentů jsou porovnány pomocí tabulek a schémat i s teoretickými východisky problematiky. Tím je naplněn druhý podcíl práce - přiblížit názory a zkušenosti zadavatelů a uchazečů a porovnat je s teoretickými východisky. Přínosem práce pak je vytvoření možného návrhu na zlepšení současné situace v oblasti transparentnosti zakázek, tím je naplněn třetí vedlejší cíl práce - pokusit se navrhnout teoreticky možné řešení problému.
