Trestné činy proti zdraví

Abstract

Cílem této práce bylo podat výklad o trestných činech proti zdraví podle Hlavy I Dílu 2 Trestního zákona. Na úvod jsem se zabývala historií trestných činů proti zdraví. Jelikož tyto trestné činy provází lidstvo od samotného počátku, z čehož vyplývá, že pojmout celou světovou historii by bylo značně obsáhlé, stanovila jsem si za cíl stručně popsat hlavní historické milníky od počátku české státnosti až po současný trestní zákoník. Další kapitola pojednává o trestných činech proti zdraví z kriminologického hlediska. Vymezila jsem zde jednotlivé typy pachatelů těchto trestných činů, jejich motivaci, příčiny z jakých trestnou činnost páchají a v neposlední řadě také možné prevenční prostředky za pomoci kterých lze trestné činnosti předcházet. Třetí kapitola obsahuje vymezení skutkové podstaty trestných činů proti zdraví. Čtyřmi obligatorními znaky každé skutkové podstaty je objekt, subjektivní stránka, pachatel a objektivní stránka. Hlavním obsahem práce je pak rozbor jednotlivých trestných činů Hlavy I Dílu 2 trestního zákoníku. Tuto hlavní část jsem systematicky rozdělila do dvou kapitol, na úmyslné a nedbalostí trestné činy. Kapitola o nedbalostních trestných činech pak podrobněji pojednává o trestných činech proti zdraví v dopravě, ve zdravotnictví a ve sportu. Na téma trestných činů proti zdraví...

The main goal of this diploma thesis was to summarize crimes against health in accordance to Chapter I Title II of the Criminal Code. Firstly I focused on history of the crimes against health. As these crimes were present during the whole human being, my goal was to describe the main historical milestones from the beggining of the Czech state until the publication of the present Criminal Code. In another chapter I described crimes against health from the criminological point of view. I defined individual types of offenders of these crimes, their motivation, causation why are they commiting crimes and last but not least the possible way how to prevent these crimes. Third chapter contains description of the main elements in crimes against health. There are four obligatory signs of every criminal offence. The object, the subjective point, the objective point and the perpetrator. Main part of this work is devoted to the analysis of the particular crimes according to Chapter I Title II of the Criminal Code. I devided this part systematicly into two chapters - intentional crimes and crimes caused by negligance.
