Abstract

RESUMÉ Nebezpečné pronásledování je trestným činem, který byl do české právní úpravy zaveden dne 1. 1. 2010 v souvislosti s přijetím a nabytím účinnosti trestního zákoníku. Postihuje jev, který je obecně ve světě známý pod pojmem stalking. Jeho rysem je upnutí se pachatele na určitou osobu, kterou opakovaně obtěžuje a vyžaduje její pozornost, přičemž charakteristické je vyvolání strachu pronásledované osoby a navození pocitu ztráty soukromí. Stalking je obecně ve světě narůstajícím problémem a po zavedení postihu stalkingu v jiných zemích kontinentální Evropy, byl postih jednání, které pod tento jev spadá zaveden i do českého trestního zákoníku. Před zavedením skutkové podstaty trestného činu nebezpečného pronásledování byly oběti stalkingu odkázány pouze na ochranu skrze prostředky občanského a správního práva. Práce je členěna do pěti kapitol, kdy první je věnována vysvětlení pojmu stalkingu, vymezením způsobů, kterými pachatelé mohou své oběti pronásledovat a procesu zavedení trestného činu nebezpečného pronásledování do našeho právního řádu. Druhá analyzuje hmotněprávní charakteristiku tohoto trestného činu, zabývá se skutkovou podstatou trestného činu nebezpečného pronásledování a zejména vymezuje jednotlivé formy jednání. The crime of stalking represents a specific form of harassment and violence, known as stalking. Since 1990 antistalking legislation became enacted first in the United States of America and in succesive steps the crime of stalking got into legislation also in the continental European territory. In the Czech Republic the crime of stalking was involved in the new Criminal Code, which became effective 1.1.2010 and is amended under § 354. The aim of this thesis was to introduce the crime of stalking in the most comprehensive way. Above all to define stalking, analyze its possible forms and manners, make an insight of this social problem from the viewpoint of the victim, to specify offendor typologies, take a think of motivation to commit this crime, to mention so-called expartner stalking and celebrity stalking as specific forms of this crime. I specifified the characteristic features and analysed the body of the crime of stalking, examined the characteristics of the objektive element sof the body of this crime, especially the duration of the pursuit, caution of a reasonable concern and the forms of possible unlawful conduct.
