Porovnání právní úpravy ochrany práv členů bytového družstva a společenství vlastníků jednotek

Abstract

Právní řády snad všech zemí se snaží vytvářet vhodné podmínky pro zajištění základní lidské potřeby bydlení. Cílem této práce je poskytnout rozbor a srovnání ochrany práv členů bytových družstev a vlastníků jednotek ve společenství vlastníků v českém právním řádu, a to jak ve vztahu členů k uvedeným subjektům tak vůči sobě navzájem. Nejprve se krátce věnuji historickému vývoji právní úpravy obou institutů, z něhož vyplývá dlouholetá tradice družstevnictví v Česku ve srovnání s moderní úpravou společenství. Následně jejich právnímu postavení podle současného právního řádu. Hlavní část práce je obsažena v kapitole III., která poskytuje přehled a rozbor základních práv a jejich ochrany. Jmenovitě v oddíle 2. této kapitoly se zabývám právy spojenými se vznikem a zánikem členství v dané právnické osobě a kde základním rozdílem je fakt, že členství v družstvu je dobrovolné, zatímco ve společenství vzniká ze zákona. Nastíněna je též problematika převodů družstevních bytů do vlastnictví členů družstev. Oddíl 3. stejné kapitoly je věnován způsobu utváření vůle entity, tedy způsobu ustavování a rozhodování v orgánech družstev a společenství vlastníků. Zvláštní pozornost je též zaměřena na značně odlišné možnosti bránit se rozhodnutí orgánů, ať už v rámci samotné entity nebo za pomoci soudního řízení, kde...

The legal orders of almost all countries strive to create suitable conditions to ensure basic human need of housing. The aim of this work is to provide analysis and comparison of the protection of rights of members of housing cooperatives and owners in the homeowner asscoiation, both in relation to members of those bodies mutually and among members and the entity. At the beginning I briefly deal with the historical development of the legislation of both institutes, which shows the long tradition of co-operatives in the Czech Republic in comparison with modern regulation of homeowner associations. Subsequently I studied their legal status under current law. The main part of this thesis is contained in Chapter III which provides an overview and analysis of basic rights and their protection. Namely, Section 2 of the same chapter concerns with the rights associated with the creation and termination of membership in the legal entity, where the basic difference is that membership in the housing cooperative is voluntary, while in the homeowner association it is established by law.
