5 Internet a autorské právo - rozsah odpovědnosti jednotlivých subjektů a způsob ochrany proti pirátství ABSTRAKT Předkládaná diplomová práce se zabývá problematikou autorského práva v prostředí Internetu. Cílem této práce je analyzovat současný vývoj modernizace autorského práva na jednotném digitálním trhu se zaměřením na příslušnou evropskou a národní právní úpravu nového odpovědnostního režimu poskytovatele služeb sdílení obsahu online. Práce je rozdělena do šesti částí, které se dělí na jednotlivé kapitoly. První část se věnuje základním institutům autorského práva. Představuje charakteristiku a obsah autorského práva, autorské dílo a mimosmluvní užití autorského díla. Druhá část představuje některé sociologické aspekty moderní společnosti, které vedou k nutnosti modernizovat autorské právo. Tato část pojednává o pojmu informace, informační společnosti a právu informačních technologií. Třetí část se zabývá Internetem, v této části je představena jeho definice, vznik a vývoj. Dále jsou popsány i související pojmy jako kyberprostor a Deep web a Dark web. Čtvrtá část práce je zaměřená především na odpovědnost poskytovatelů služeb informační společnosti v prostředí Internetu. 5 The Internet and copyright - the scope of liability of individual parties involved and modes of protection against piracy ABSTRACT This diploma thesis deals with copyright issues in the Internet. The aim of this thesis is to analyse the current evolution of copyright modernisation in the Digital Single Market, focusing on the relevant European and national regulation of the new liability regime of the online content-sharing service provider. The thesis is divided into six parts, which are divided into individual chapters. The first part is devoted to the basic institutes of copyright. It also describes the characteristics and content of copyright, the copyright work and the non-contractual use of the copyright work. The second part presents some sociological aspects of modern society which lead to the need to modernise copyright. This part deals with the notion of information, information society and information technology law. The third part deals with the Internet, in this part its definition, creation and development is presented. Also related terms such as cyberspace, Deep web and Dark web are described.
