child, child interrogation, criminal proceedingsIII. Abstrakt Tato diplomová práce se zabývá popisem specifických prvků vyskytujících se při výslechu dětí. Jedná se o prvky jak právní, tak psychologické a zároveň zhodnocení jejich vzájemného propojení. Úvod je zaměřen na obecnou, historicky zakotvenou ochranu dítěte a osobní několikaletou zkušenost v rámci práce s dětmi. Zároveň je zmíněn vývoj v metodách výchovy, který souvisí mimo jiné i s liberalizací společnosti. První kapitola textu se věnuje osobě dítěte, jeho právnímu postavení z historického hlediska a především historii výslechů, dále vývojové periodizaci, která je dle Václava Příhody dělena do 7 období. Podrobněji je rozebráno období prvního a druhého dětství, pubescence a adolescence. V této kapitole je dále věnován prostor faktorům, které mládež ovlivňuji. Mezi tyto faktory patří rodina, školská zařízení a jiné dětské skupiny. Hlavním tématem kapitoly druhé je nastínění základních rysů výslechu dle současné kriminalistické teorie. Pozornost je věnována jak obecnému rozdělení výslechu, tak jeho přípravě a rozdělní do stádií, které teorie rozlišuje. Kapitola třetí společně s kapitolou čtvrtou jsou stěžejní částí práce. Nejprve jsou popsána obecná východiska výslechu dítěte, zásady uplatňované při výsleších, specifické oblasti výslechu, povaha kladených otázek a osobnost vyslýchajícího. Stručně...
IV. Summary This thesis deals with legal elements of a child interrogation and psychological elements of this interrogation as well. This thesis deals both legal and psychological elements and, at the same time, a comprehension of their interconnection. Introduction part is focused on general, historically embedded child protection and personal experience over several years in working with children. At the same time, the development of methods of education is mentioned, which is connected, among other things, with the liberalization of society. The first chapter of the text is devoted to the personality of the child and their legal status from the historical point of view, as well as the developmental periodization, which is according to Vaclav Příhoda divided into 7 periods. In more detail, is presented the first and second childhood period, puberty and adolescence periods are analyzed as well. This chapter also focuses on the factors that influence youth. These factors include family and related heredity, school facilities, and other child groups. The main theme of chapter two is to outline the basic features of interrogation according to current criminological theory.
