Postavení starosty v systému orgánů obce

Abstract

Hlavním cílem této práce je poskytnutí informací o právním postavení a činnosti starosty obce. S tím souvisí i rozebrání organizace obce a vztahu jejích jednotlivých orgánů dle současně platné právní úpravy, či zhodnocení postavení starosty v různých situacích, do nichž se v souvislosti s výkonem své funkce dostává. Tuto práci lze rozdělit na několik částí, z nichž jedna část se stává z prvních dvou kapitol, které se věnují vývoji územní samosprávy a její současné zákonné úpravě. Za další část lze označit kapitolu třetí až pátou, věnující se konkrétní úpravě funkce starosty obce, jeho práv a povinností v jednotlivých situacích, vzniku a zániku mandátu a postavení zástupce starosty obce, tedy místostarosty. Poslední částí je pak kapitola šestá a sedmá, jež se věnuje právní úpravě místní samosprávy na Slovensku a volbě starosty obce. Především je pak v kapitole sedmé řešen problém týkající se změny způsobu volby starosty v České republice z volby nepřímé na přímou. Tato diplomová práce je tedy snahou o ucelení informací týkajících se daného tématu. Dotýká se různých sfér působení starosty obce, právní úpravy této funkce, jež se prolíná nemalou částí zákonů, a také aktuální otázky spojené s volbou starosty. Ta je pak v závěru této práce shrnuta.

The main objective of this thesis is to provide information about the legal status and activities of a municipality mayor. The topic is related to the analysis of municipality organization and relations among its institutions according to the current legislation, as well as the evaluation of the position of a mayor in various situations that he may encounter during the performance of his duties. The thesis can be divided into several parts. One part consists of the first two chapters which describe the development of local governments and their current legislative framework. The next part consists of chapters Three to Five which deal with the specific functions of a mayor, his rights and obligations in various situations, the start and the end of his mandate, and the position of a deputy mayor. The last part is chapters Six and Seven which describe the legislative framework for local governments in Slovakia and the election process of a mayor there. The seventh chapter primarily deals with the problem concerning the changes in the way mayors are elected in the Czech Republic, from indirect election to a direct one.
