Abstract

Anglický abstrakt The Food Law in the Czech Republic and in Foreign Countries The purpose of my thesis is to analyse and characterise the food law in the Czech Republic and in selected foreign countries. The thesis focuses on providing comprehensive view of the general part of food law but also discusses selected aspects of food law and related issues. The reason for my thesis is my long-term interest in the field of human nutrition. Therefore I intended to gain some knowledge of the legal framework of food. My thesis is based on the aproach of analysis and synthesis. I also use the linguistic, logical and historical method in my thesis. The comparative method is used in the two last chapters (Chapter Twelve and Thirteen) which deal with the comparison of food law in the Czech Republic and selected countries. The text of my thesis is divided into chapters, subchapters and parts. The thesis is composed of fourteen chapters (including Preface - Chapter One, Introduction - Chapter Two and Conclusions - Chapter Fourteen). Český abstrakt Cílem mé diplomové práce je analyzovat a charakterizovat potravinové právo v ČR a ve vybraných zemích. Práce se zaměřuje na poskytnutí uceleného pohledu na obecnou část potravinového práva, ale pojednává také o některých vybraných aspektech potravinového práva a o problematice související. Téma "Potravinové právo v ČR a zahraničí" jsem si zvolila proto, že se dlouhodobě zajímám o oblast výživy člověka a chtěla jsem proniknout do právní úpravy této problematiky. Ve své práci vycházím z analytické a syntetické metody a používám také metodu jazykovou, logickou a historickou. Metoda komparativní pak své uplatnění nalézá v posledních dvou částech (část dvanáctá a třináctá), které srovnávají potravinové právo v ČR a ve vybraných zemích. Z hlediska struktury je práce členěna do částí, kapitol a podkapitol. Včetně předmluvy (část první), úvodu (část druhá) a závěrů (část čtrnáctá) je práce rozdělena do čtrnácti částí. Třetí a čtvrtá část vymezují postavení potravinového práva v právním řádu ČR, definují základní pojmy (potraviny, potravinové právo) a poskytují přehled pramenů práva na národní, evropské i mezinárodní úrovni.
