Zvláštnosti výslechu dětí

Abstract

This diploma thesis focuses on the matters of children interrogation -specifically persons younger than 15 years being in position of victims or witnesses of crime. Even though I narrowed down the topic of the thesis, it is certainly very broad and complicated one which can be discussed more in depth. Children interrogation usually requires extensive efforts of the interrogating person - patience and empathy above all. Also, previous experience and the understanding that each case is individual and each child has to be apporached in a different way, are crucial. The interrogating's objective is to find out the relevant information and prevent secondary victimisation of the child at the same time. Diploma thesis contains two parts - theoretical and practical. Theoretical part is focused on Czech legal regulations related to these matters, specifics of child personality (ontogenesis, temperament and child character) and methods of interrogation (analyses single stages of the interrogation, deposition, documentation, persons taking part in the interrogation and possible mistakes which can be made). Tato diplomová práce se věnuje problematice výslechu dětí - konkrétně osob mladších 15 let v pozicích obětí a svědků trestných činů. Výslech dětí vyžaduje značné úsilí vyslýchajícího - především trpělivost a značnou míru empatie. Důležité jsou také předchozí zkušenosti a vědomí, že každý případ je individuální, a ke každému dítěti je proto nutné přistupovat odlišně. Cílem vyslýchajícího je zjistit od dítěte relevantní informace a přitom zabránit sekundární viktimizaci dítěte. Diplomová práce se skládá ze dvou částí - teoretické a praktické části. Teoretická část se zabývá především českou právní úpravou problematiky, specifiky dětské osobnosti (ontogenezí, temperamentem a charakterem dětí) a metodikou výslechu (rozebírá jednotlivá stadia výslechu; dokumentaci průběhu výpovědi; osoby účastnící se výslechu a možné chyby, kterých se mohou dopouštět). Velký důraz je zde kladen na vhodné výslechové prostředí, přístup k dětem a předcházení sekundární viktimizaci. Práce neopomíjí ani specifické problémy spojené s výslechem, jako je například lživě vypovídající dítě, či dítě, které si nedokáže na předmětné události vzpomenout - v obou případech nabízí práce objasnění příčin, možná řešení a metodiku přístupu k těmto dětem.
