Abstract

Resumé Domácí násilí a jeho prevence Tato diplomová práce se zabývá problematikou domácího násilí a jeho prevence. Cílem práce je analyzovat instituty, které poskytuje český právní řád k ochraně před domácím násilím. Práce je členěna do šesti kapitol, každá se věnuje zvláštním aspektům dané problematiky. Úvodní kapitola představuje fenomén domácího násilí. Snaží se vymezit pojem domácí násilí, popsat jeho znaky a formy, aby tyto poznatky mohly být následně použity v dalších částech práce. Dále se zabývá teoriemi příčin, které se snaží vysvětlit, proč k domácímu násilí dochází. Druhá kapitola se věnuje osobě pachatele z hlediska jeho obecné charakteristiky a osobnostních rysů. Pozornost je také věnována genderovým aspektům. Třetí kapitola se soustředí na osobu oběti z hlediska její obecné charakteristiky a zabývá se procesem viktimizace, tedy přeměnou potenciální oběti v oběť skutečnou. Rozlišujeme viktimizaci primární, sekundární a terciární. Další část popisuje psychické následky postihující oběti domácího násilí. Zvláštní pozornost je věnována jednotlivým skupinám obětí - muži, děti, senioři, ženy. Ve čtvrté kapitole je zkoumána česká legislativní úprava a instituty, které jsou poskytovány k ochraně před domácím násilí. Domestic violence and its prevention The thesis is concerned with the problematics of domestic violence and its prevention. The aim of the thesis is to analyze the legal institutes that are provided by the Czech legislation for protection against domestic violence. The thesis is divided into six chapters each of which adresses special aspects of the problematics. The first chapter introduces the phenomenon of domestic violence. It tries to define the notion of domestic violence, describe its features and forms so that these pieces of information can be used in further parts of the thesis. Subsequently, it deals with theories that try to explain the causes of domestic violence. The second chapter is concerned general characteristics and personal traits of the perpetrator. Attention is also dedicated to gender aspects. The third chapter concentrates on general characteristics of the victim and adresses the process of victimization, i.e. the transformation of a potential victim into a real one. Primary, secondary and tertiary victimization are to be distinguished. The next part describes the mental consequences of the victim of domestic violence.
