Money laundering, obliged person, bank, AML, suspicious transaction, identification dutyHlavním cílem předkládané práce 'Právní a institucionální zabezpečení finančního systému proti praní špinavých peněz' je poukázat na stále rostoucí fenomén praní špinavých peněz. Jedná se o fenomén nabourávající globální ekonomický a finanční systém, který by neměl zůstat bez povšimnutí. Tomuto fenoménu je nutno čelit všemi dostupnými, legálními prostředky. Aby účinek tohoto boje byl co největší, pak je nutno, aby zde existovaly celosvětově uznávané právní normy, které by za své přijalo maximum států, aby zde byly orgány vybavené kvalifikovaným personálem, s dostatečnými pravomocemi, aby především bankovní instituce, ale nejenom ty, vyvinuly maximální úsilí v boji proti praní špinavých peněz, zaměřené především na prevenci. Pokud nebudou nejen shora uvedené podmínky splněny, pak jen stěží půjde tomuto fenoménu adekvátně čelit.
The main objective of this work 'Legal and institutional security of the financial system against money laundering' is to highlight the growing phenomenon of money laundering. It is a phenomenon causing collision of the global economic and financial system, which should not remain unnoticed. This phenomenon must be tackled by all, by legal means. To combat this effect was greatest, then it is necessary that there was a globally recognized legislation that would have embraced most states that there were institutions with qualified personnel with sufficient powers, primarily banking institutions, but not limited to those utmost efforts in the fight against money laundering. If the above conditions are not met, then it will hardly be able to face this phenomenon.
