Koncept "Responsibility to Protect" v mezinárodním společenství. Případová studie Súdánu

Abstract

Tato diplomová práce se zabývá konceptem "Responsibility to protect" v mezinárodním společenství z obecného hlediska a také v praxi na případu konfliktu v Dárfúru. První část práce je teoretická a věnuje se samotnému konceptu. Jsou v ní popsány jeho vznik, obsah, tři hlavní pilíře a definice kategorií zločinů, na které se koncept vztahuje. V první části práce jsou také analyzovány postoje nejdůležitějších mezinárodních aktérů ke konceptu z hlediska jeho možného použití v praxi. Poslední kapitola první části analyzuje problémy, úskalí a výzvy konceptu, na které může mezinárodní společenství při jeho implementaci narazit. Druhá část práce se zaměřuje na konflikt v Dárfúru; pro pochopení souvislostí se nejdříve věnuje historickému vývoji Súdánu a Dárfúru a poté konfliktu, který propukl v roce 2003. Nejprve se kapitola zabývá průběhem konfliktu mezi lety 2003-2009 a poté je diskutováno zapojení a vliv mezinárodních aktérů v konfliktu tj. především Rady bezpečnosti OSN, Africké unie a USA. Ve své třetí části práce propojuje koncept R2P a konflikt v Dárfúru. V rámci každého pilíře jsou aplikovány jeho hlavní principy na konflikt v Dárfúru, analyzuje se, zda došlo ke spáchání zločinů popsaných v R2P, aby mohl být koncept aplikován. The thesis "Concept Responsibility to Protect Within International Community: Sudan Case Study" focuses on the R2P concept and its implications since its approval at the World Summit in 2005. The theoretical part of the thesis explains the R2P concept, its constitution, the three pillars and their main principles, and categories of crimes on which the concept can be applied. This section includes an analysis of attitudes, which the key international actors adopted towards the R2P. The last chapter of the theoretical part examines the main problems, challenges and difficulties of the concept which could the international community face when implementing the concept. The practical part of this thesis relates to the conflict in Darfur. Its first chapter deals with the evolution of tensions in Sudan, which had affected the current conflict. The second chapter focuses on the present conflict since its beginning in 2003, including the debate about the possibility of potential genocide committed by the Sudanese government. The involvement of the key international actors (the UNSC and AU) in the conflict is discussed in this part as well.
