JUDr. Jiří Švestka, DrSc. Praha, září 2011 Abstrakt Soukromoprávní aspekty ochrany spotřebitele Cílem této diplomové práce je popsat problematiku ochrany spotřebitele v soukromém právu. Autor se zaměřil především na nejnovější změny v platné právní úpravě zabývající se ochranou spotřebitele. Součástí práce je taktéž kritické zhodnocení aktuální právní úpravy a její porovnání s návrhem nového občanského zákoníku. Diplomová práce by měla přispět k diskuzi o probíhající rekodifikaci soukromého práva. Práce je rozdělena do deseti kapitol. První kapitola se zabývá vymezením pojmu ochrany spotřebitele a práva ochrany spotřebitele. Obsahuje též stručný exkurz na téma ochrana spotřebitele ve veřejném právu. Druhá kapitola se skládá z výčtu právních předpisů, které regulují ochranu spotřebitele. Nejprve přináší seznam vnitrostátních pramenů ochrany spotřebitele v české legislativě. Dále obsahuje přehled právních předpisů chránících spotřebitele v komunitárním právu, a to jak v primárním, tak i sekundárním. Prague, September 2011 Abstract Private law aspects of consumer protection The aim of this thesis is to analyze the issue of consumer protection in private law. The author focused mainly on the latest changes in the applicable legislation dealing with the consumer protection. The thesis also contains critical evaluation of current legislation and a comparison with the draft of the new Civil Code. The thesis should contribute to the discussion of the ongoing recodification of private law. The thesis is divided into ten chapters. The first chapter deals with the definition of the term consumer protection and consumer protection law. It also includes a brief excursion on the topic of consumer protection in public law. The second chapter consists of a list of acts that regulate consumer protection. First, it brings a list of national sources of consumer protection in the Czech legislation. It also contains an overview of the legislation protecting consumers in Community law, both in the primary, and the secondary legislation.
