Abstract

disertační práce Ústava pro Evropu JUDr. Jiří Feichtinger Ústředním tématem této disertační práce je posouzení a hodnocení Smlouvy o Ústavě pro Evropu ("ústavní smlouvy") a tzv. zakládacích smluv, tj. Smlouvy o Evropské unii a Smlouvy o fungování Evropské unie (dále jen "zakládací smlouvy") z hlediska teorie ústavního práva a obecné státovědy. Ze stejných hledisek proto zkoumám i povahu Evropské unie. Toto téma jsem zvolil z důvodu stále častější a intenzivnější diskuse o míře evropské integrace, o její potřebě a smyslu a především o tom, zda se Evropská unie stává státem nebo zda zůstává stále jen mezinárodní organizací svého druhu. V této práci hledám odpověď na otázku, nakolik obsah ústavní smlouvy odpovídal jejímu názvu a byl-li tento dokument z ústavněprávního hlediska skutečně ústavou; na tuto otázku odpovídám i ve vztahu k zakládacím smlouvám. V práci dále zkoumám, zda ústavní smlouva či smlouvy zakládací otevírají cestu ke sjednocené Evropě nejen z hlediska dosavadního zaměření evropské integrace, ale i z hlediska státovědeckého, tj. zda by tyto smlouvy mohly sloužit jako základní právní předpis Evropy jako jednotného státu, což je hlavním smyslem existence jakékoli ústavy. of Content and Conclusions of Dissertation Constitution for Europe JUDr. Jiří Feichtinger The central subject-matter of the dissertation is the assessment of the Treaty establishing the Constitution for Europe ("constitutional treaty") and the co called founding treaties, i.e. the Treaty on European Union and the Treaty on the Functioning of the European Union ("founding treaties") from the viewpoint of the constitutional law and the general theory of state. From the same viewpoints I also examine the nature of the European Union itself. When choosing this topic of my dissertation I was inspired by ever growing discussions on the extent of the European integration and its purpose, whether it is at all necessary, and whether the European Union is becoming a state or rather remains an international organization sui generis. I am trying to answer, to what extent the content of the constitutional treaty corresponded to its name and whether this document could at all be called a constitution; the same question is being answered with regards to the founding treaties.
