Abstract

Problematika BOZP je vnímána EU jako důležitou součást sociální politiky EU. Má Věrka význam zejména při udržování sociálního smíru, který je velmi podstatný pro podnikatelské prostředí. Zároveň je BOZP důležitým faktorem souvisejícím s hospodářskou soutěží, která se utváří mezi podnikatelský subjektmi používajícími se na jednotném vnitřním trhu EU. Zdůrazňujeme tím zavádění rovných podmínek mezi tržními subjekty z hlediska nákladovosti práce. Z těchto důvodů v tvoří soubor směrenic Rady ES týkajících se BOZP největším část závazného sociálního acquis communautaire. Tvoří ho zejmena dvě rámcová směrnice Rady (89 / 39I / EHS a 80/1107 / EHS) a cca 30 navazujících dílčích směrnic pokrývajících různé oblasti a aspekty bezpečnosti práce a hygieny práce (tj. ochranu zdraví při práci). Institucionální je tato problematika upravena Nařízení Rady o zřízení evropské Agentury pro bezpečnost a zdraví při práci (č. 94/2062 / EEC a č. 95/1643 / EEC), Rozhodnutím Rady o ustavení Výboru vedoucích inspektorů práce (95/319 / EEC) a poradního výboru pro bezpečnost, hygienu a zdraví při práci (74/325 / EEC) a Rozhodnutím Rady o opatřeních pro zlepšení informaci o bezpečnosti, hygieně a zdraví při práci (S8 / 383 / EEC). In this thesis ! atn addressing the topic of safety and health at work. I chose this topic, because after finishing my studies I myself will also integrate into the work life, thus the issue of health protection would apply to me, as to an employee, as well. I felt the necessity to point out the possibility of health damage caused by the harmful factors of the work environment, according to the lack of attention paid to it not only by the employers, but also in general. 1 divided my work into three main sections. In the first section I provide a briefing of historical and legal developments of work safety, I describe a current state of law - on international level, on the level of EU legislation and also on the level of national/ Czech legislation. In the second section of my thesis E try to bring closer the function of the state in this area. I give an overview of rights and duties of employers and employees, as well as of those of self-employed persons, which occur in the employment and similar relationships. I show the former and current state of observance of these laws in practice by the interpretation of particular provisions of laws that have either direct or indirect effect on the given topic.
