Abstract

64 Závěr Právní úprava ochrany lesa se nachází v celé řadě právních předpisů. Pro znalost právní úpravy ochrany lesa je nutné se obeznámit se všemi. Práce se snaží popsat les a jeho prostředí, prameny právní úpravy, kategorie lesů, pozemky určené k plnění funkcí lesa a zdroje ohrožování lesa. Dále se zabývá hospodařením v lesích a ochranou lesa při obecném užívání veřejností. Popisuje strukturu orgánů státní správy lesů a základním způsobem se zabývá odpovědností v ochraně lesa. Celá práce je rozdělena do devíti kapitol, které se zabývají odděleně jednotlivými problémy ochrany lesa a jejich právní úpravou. Cílem práce bylo les popsat a zjistit jakým způsobem platná právní úprava chrání jednotlivé části lesa a zda je tato ochrana dostatečná. Snažila jsem se v práci upozornit na hlavní nedostatky právní úpravy ochrany lesa a některé z nich uvádím v závěru. Jsou zde shrnuty ty nejdůležitější, aby mohla být zodpovězena otázka zda je právní úprava lesa dostatečná. Současnými problémy lesního hospodářství jsou především existence smrkových a borových monokultur, uplatňování pasečného hospodářství a vysoké stavy spárkaté zvěře. Snaha zmenšit podíl monokultur v našich lesích je v lesní legislativě vyjádřena stanovením minimálního podílu melioračních a zpevňujících dřevin. Tato ustanovení stanoví pouze doporučený...

77 Summary Legal regulation of forest protection The purpose of this Master's Degree Thesis is to examine the legal regulation of forest protection. The thesis focuses mainly on current forest legislation in the Czech Republic. The main purpose of this study is to ascertain whether the existing forest protection legislation is efficient and sufficient. And I also caused two general parts of legal regulation which are protection land designated to fulfil the function of forest and protection of forest against harmful factors. The work is divided into nine chapters. Chapter One defines the forest as a whole, its functions and questions of its protection. Chapter Two ascertains the legal regulation of international forest protection, European and national level. There is examined the national development of legal regulation of the forest protection. The aim of Chapter Three is to look at criteria used to divide forests into individual categories. Chapter Four defines the aims of protection land designated to fulfil the function of forest. Chapter Five examines the protection of forest agains harmful factors. The following Chapter Six defines the main legal regulation of forest economics.
