Pojem a právní důsledky překročení mezí nutné obrany a krajní nouze

Abstract

Pro vypracovani diplomove prace jsem si zvolil tema "Pojem a pravni důsledky překročeni mezi nutne obrany a krajni nouze". Diplomovou praci v oblasti trestniho prava jsem si vybral z důvodu velice vyznamne a nezastupitelne role trestniho prava v lidskem životě. Mnohdy se s nim člověk za cely život přimo nesetka, avšak po celou dobu života trestni pravo naš život zastřešuje a slouži k ochraně nejzakladnějšich pravnich statků. Nutna obrana a krajni nouze, jakožto nejdůležitějši instituty okolnosti vylučujici protipravnost jsou důležite prvky trestniho prava ve všech pravnich řadech světa. Vyskytuji se v různych modifikacich determinovanych historickym a politickym vyvojem jednotlivych zemi. Tema, resp. problematika okolnosti vylučujici protipravnost a zvlaště problematika nutne obrany a krajni nouze mě zaujala již při prvnim seznameni s trestnim pravem na Pravnicke fakultě Univerzity Karlovy v Praze. Okolnosti vylučujici protipravnost a zejmena meze jednani v nutne obraně a krajni nouzi, včetně jejich překročeni, jsou široce diskutovana temata nejen v odbornych kruzich, ale i u laicke veřejnosti. Concept and the legal consequences of breaching the limits of necessary defense and extreme emergency The necessary defense and extreme emergency are institutes, which quarantee indemnity to acting person in the situation of necessary defense and extreme emergency. Both insitutes have long tradition in law orders all over the world. The limits of acting in necessary defense and extreme emergency are set up little differenlty in each country. Breaching of the limits necessary defense or extreme emergency occurs, if the offender commits the offense diverting attack or other danger without being fully met the conditions necessary defense or extreme emergency. The person is entitled to act in the necessary defense or extreme emergency, if complied with statutory requirements (conditions) which are defined in penal code and can not breakes the limits of necessary defense or extreme emergency. A crucial condition for the situation of necessary defense is directly threatening or continuing attack on the interests protected by penal code, in case of extreme emergency is a danger directly threatening to the interests protected by penal code.
