Abstract

Pracovnělékařské prohlídky a jejich význam v pracovním právu Abstrakt Diplomová práce se zabývá problematikou pracovnělékařských prohlídek a jejich významem v pracovním právu. Cílem je analyzovat pracovnělékařské prohlídky, jakož i další instituty s tímto tématem související. Pozornost je zaměřena na změny právní úpravy, které v nedávné době nabyly účinnosti. Diplomová práce je členěna do čtyřech kapitol. První kapitola se věnuje obecnému tématu pracovnělékařských služeb. Popisuje mezinárodní, evropské i vnitrostátní prameny právní úpravy, definuje pojem pracovnělékařských služeb a specifikuje jejich obsah. Dále analyzuje subjekty pracovnělékařských služeb, kterými jsou poskytovatel pracovnělékařských služeb, zaměstnavatel a zaměstnanec. Ve druhé kapitole je podrobně rozebráno stěžejní téma práce, a to pracovnělékařské prohlídky. Tento institut je nejprve rozebrán z obecného hlediska, přičemž následně je přistoupeno k analýze jednotlivých druhů pracovnělékařských prohlídek, kterými jsou prohlídka vstupní, periodická, mimořádná, výstupní a následná. Zvláštní pozornost je věnována nedávným změnám, zejména zásadní novelizaci právní úpravy periodických prohlídek. Occupational health examinations and their importance in labour law Abstract The thesis focuses on the issue of occupational health examinations and their significance in labour law. The aim is to analyse occupational health examinations as well as other institutes related to this topic. Attention is focused on the changes in legislation that have recently come into force. The thesis is divided into four chapters. The first chapter is dedicated to the general topic of occupational health services. It describes international, European and national sources of legislation, defines the concept of occupational health services and specifies their content. It then analyses the subjects of occupational health services, which are the provider of occupational health services, the employer and the employee. In the second chapter, the main topic of the thesis, namely occupational health examinations, is discussed in detail. This institute is first discussed from a general point of view, and then it is proceeded to the analysis of the different types of occupational health examinations, which are entry, periodic, emergency, exit and follow-up examinations.
