Abstract

Metodika vyšetřování loupeží Abstrakt Tato diplomová práce se zabývá metodikou vyšetřování loupeží, konkrétně jejími vybranými komponentami, kterými jsou kriminalistická charakteristika loupeží, způsoby páchání loupeží zaměřené na vybrané způsoby páchání a typické stopy. Podává tak hlubší náhled do těchto částí vyšetřovacího procesu, zachycuje jejich specifika a poskytuje srovnání se zahraniční literaturou. Práce je rozdělena do čtyř kapitol, které na sebe navazují a vzájemně spolu souvisí. První kapitola představuje trestný čin loupeže, jak je upravený v zákoně č. 40/2009 Sb., trestním zákoníku, tedy jeho postavení v současném českém právním řádu. Nastiňuje předmět metodiky z hlediska trestního práva. Druhá kapitola se věnuje kriminalistické charakteristice loupeží. V jednotlivých podkapitolách rozebírá kriminální situaci, způsoby páchání loupeží, pachatele a oběť loupeží, a nakonec se zabývá motivem činu a kritérii pro výběr oběti. Tato kapitola nabízí množství statistických údajů souvisejících s loupežemi. Podkapitola, která se zaměřuje na způsoby páchání loupeží, poskytuje různé druhy klasifikace, včetně typologií zahraničních autorů, a další významné komponenty ve způsobu páchání loupeží. The Methodology of Robbery Investigation Abstract This diploma thesis deals with the methodology of robbery investigation, specifically with its selected components of the investigation. The selected parts are criminalistic characteristic of robberies, the typical ways of committing robberies divided according to the intensity of aggression and the typical evidence. The thesis provides with a deeper insight into these parts of the investigation process, captures their specifics and provides a comparison with foreign literature. The presented thesis is divided into four chapters, which are related and follow each other. The first chapter presents the crime of robbery, as regulated in Act No. 40/2009 Coll., The Criminal Code, and its position in the current Czech legal system. It outlines the subject of the methodology from the point of view of criminal law. The second chapter deals with the criminalistic characteristic of robberies. In the individual subchapters, it discusses the criminal situation, the typical ways of committing robberies, the offender and the victim of robbery, and finally deals with the motive of the criminal act and the criteria for selecting the victim.
