Abstract

Criminalistic issues of the investigation of sexual criminal acts ABSTRACT The diploma thesis examines the methodology of the investigation of a crime of child sexual abuse. It provides not only a theoretical explanation of those issues, besides that demonstrates real findings obtained by the research of the terminated court records. The facts of the crime of sexual abuse is nowise new. Indeed, it had often been the main focus of academical literature and discussions. Considering the fact of the high intensity of sexual abuse commitment alongside the high latency related, this act is still a burning topic. Therefore, the thesis tries to emphasise some theoretical and practical difficulties of its detection / investigation and compare the compliance of the results of the research with the developed methodologies. The thesis is thematically divided into three sections. The first segment outlines the development of the legal regulation of the crime of child sexual abuse, explains the concept of the child sexual abuse and the concepts related in detail, presents actual statistic data concerning this crime in the year 2018, states the problem of perpetrator and victim of child sexual abuse and describes its typical ways of committing. Kriminalistické problémy vyšetřování sexuálních deliktů ABSTRAKT Diplomová práce je zaměřena na metodiku vyšetřování trestného činu pohlavního zneužití. Podává nejen teoretický výklad uvedené problematiky, ale také uvádí reálné poznatky získané studiem ukončených soudních spisů. Skutková podstata trestného činu pohlavního zneužívání není v trestním právu novinkou a je často předmětem odborných prací a diskuzí. S ohledem na skutečnost, v jak vysoké míře je tento trestný čin páchán, a ve spojení s vysokou latencí, kterou se vyznačuje, se ovšem stále jedná o velmi aktuální téma. Práce má proto snahu zdůraznit některá teoretická i praktická úskalí jeho odhalování / vyšetřování a porovnat soulad výsledků vlastního šetření s vypracovanými metodikami. Práce je tematicky rozdělena do třech celků, kdy první z nich nastiňuje vývoj právní úpravy samotného trestného činu pohlavního zneužití, detailněji vykládá pojem pohlavního zneužití a pojmy související, prezentuje aktuální statistická data ohledně tohoto deliktu za rok 2018, uvádí problematiku pachatele a oběti pohlavního zneužití a popisuje jeho typické způsoby spáchání. V druhé části je popsána samotná metodika vyšetřování deliktu pohlavního zneužití, konkrétně je čtenář uveden do problematiky místa činu, typických stop, typických vyšetřovacích situací,...
