Abstract

Criminal aspects of infringement of Intellectual Property Rights Intellectual property directly relates to the development of society and economy. Higher level of legal protection provided by the State affects the creation of intellectual property objects, since creators are motivated to create in legal environment which provides them with adequate means of rights protection. This thesis lays down an analysis of the means of the Intellectual Property Rights protection in order to determine their level of the protection in the Czech Republic. The author compares civil, administrative and criminal means of protection of copyright and related rights, and industrial rights, and draws attention to their advantages and disadvantages, to gaps and inconsistencies in law, and in appropriate places inserts suggestions de lege ferenda. The thesis addresses not only individuals but also with legal entities, which are also able to infringe protected rights. The thesis concentrates on criminal aspects of Intellectual Property Rights infringement and this issue is therefore the major part of the thesis. Zhrnutie Trestnoprávne aspekty porušenia práv k duševnému vlastníctvu Duševné vlastníctvo priamo súvisí s rozvojom spoločnosti a hospodárstva. Vyššia úroveň právnej ochrany zabezpečená štátom má vplyv na tvorbu predmetov duševného vlastníctva, pretože tvorcovia sú motivovaní tvoriť v takom právnom prostredí, ktoré im súčasne poskytuje adekvátne prostriedky na ochranu svojich práv. Táto práca sa tak zaoberá analýzou prostriedkov ochrany práv k duševnému vlastníctvu, a to s cieľom zistiť úroveň ochrany týchto práv v Českej republike. Autor navzájom porovnáva civilné, správnoprávne a trestnoprávne prostriedky ochrany autorského práva, práv s ním súvisiacich a priemyselných práv a upozorňuje na ich výhody a nevýhody, medzery a nezhody v právnej úprave a na vhodných miestach vkladá návrhy de lege ferenda. Práca sa zaoberá nielen fyzickými osobami, ale i osobami právnickými, ktoré sú tiež spôsobilé na zásah do chránených práv. Práca sa zameriava na trestnoprávne aspekty porušenia práv k duševnému vlastníctvu a táto problematika tak tvorí najväčšiu časť práce. Vzhľadom na to, že je trestné právo najprísnejším prostriedkom v rukách štátu, autor skúma jeho úlohu v oblasti ochrany práv k duševnému vlastníctvu.
