Zaměstnávání osob se zdravotním postižením

Abstract

Resumé The topic of my thesis is the employment of people with disabilities. In the thesis I deal with legal status of persons with disabilities and the instruments for protection and support in the area of employment. The thesis is divided into the introduction, nine chapters divided further into sub-chapters and sections, the conclusion and the annexes. The first chapter defines the term person with disability under international law, specifically in documents of International Labour Organisation, World Health Organisation, United Nations Organisation, Council of Europe, and under Czech legal system. In the second chapter I deal with the provisions of working conditions of persons with disabilities under the above international organisations. Furthermore, this chapter presents the actual actions of Council of Europe in the area of the rights of persons with disabilities. The third chapter briefly covers the European Union legislation of employment of people with disabilities The fourth chapter covers the fundamental rights and the principles related to employment of people with disabilities. Tématem mé diplomové práce je zaměstnávání osob se zdravotním postižením. Zabývám se v ní zejména právním postavením osob se zdravotním postižením a nástroji sloužícími k jejich ochraně a podpoře v oblasti zaměstnanosti. Práce se skládá z úvodu, devíti kapitol, které se dále dělí do podkapitol a oddílů, závěru a příloh. První kapitola vymezuje pojem osob se zdravotním postižením v mezinárodním právu, konkrétně v dokumentech Mezinárodní organizace práce, Světové zdravotnické organizace, Organizace spojených národů a Rady Evropy, a v českém právním řádu. V druhé kapitole se zabývám převážně úpravou pracovních podmínek osob se zdravotním postižením v rámci výše uvedených mezinárodních organizací. Kromě toho tato kapitola také seznamuje s aktuální činností Rady Evropy v oblasti práv osob se zdravotním postižením. Třetí kapitola krátce pojednává o právní úpravě zaměstnávání osob se zdravotním postižením v rámci Evropské Unie. Čtvrtá kapitola je věnována základním právům a zásadám souvisejícím se zaměstnáváním osob se zdravotním postižením. Pátá kapitola se zabývá ustanoveními zákoníku práce, která ukládají povinnosti zaměstnavatelům zaměstnávajícím osoby se zdravotním postižením, a dále také významnou právní úpravou odměňování a její novelizací sloužící k podpoře osob se zdravotním postižením.
