Mezinárodní civilní procesní právo v Evropské unii - vybrané otázky : ochrana spotřebitele v nařízení Brusel I bis

Abstract

Cílem této práce je podrobně proniknout do problematiky ochrany spotřebitele v nařízení Brusel I bis, do určování mezinárodní příslušnosti soudů a otázky uznání a výkonu rozhodnutí. Práce se zaměřuje zejména na odlišné postavení spotřebitele a instituty, které zlepšují jeho postavení. Diplomová práce se skládá z 9 kapitol, které se pro přehlednost dále člení na podkapitoly a další body. První kapitola se zabývá samotným spotřebitelem a vysvětluje důvody jeho ochrany. Druhá kapitola uvádí do problematiky mezinárodního práva soukromého a evropského mezinárodního práva soukromého, včetně evropského justičního prostoru. Třetí kapitola popisuje vývoj právní úpravy v oblasti justiční spolupráce v občanských a obchodních věcech od Bruselské úmluvy až po nařízení Brusel I bis, a zmiňuje úpravy, kterými předpisy prošly. Kapitola se rovněž věnuje odlišnému postavení některých států v rámci justiční spolupráce. Čtvrtá kapitola se zaměřuje na předmět úpravy nařízení Brusel I bis, uvádí druhy příslušnosti podle tohoto předpisu a vysvětluje jejich vztah. Věnuje se však i působnosti nařízení z jeho časového, věcného a prostorově personálního hlediska. Pátá kapitola se zaobírá několika instituty. The purpose of this thesis is to analyse in detail the issue of consumer protection within the Brussels I bis regulation, establishment of the international court jurisdiction and the question of recognition and enforcement of a judgement. The thesis concentrates especially on a different position of consumer and measures that amend his situation. The thesis is composed of 9 chapters that are further divided into subchapters and points. Chapter One is an introductory chapter focusing on a consumer and defining reasons for his protection. Chapter Two explains the topic of international private law and european international private law, including the European judicial area. Chapter Three describes the development of legislation in the area of judicial cooperation in civil matters since the Brussels convention up to the Brussels I bis regulation and mentions respective changes. The chapter also focuses on different status of certain countries within the European judicial cooperation. Chapter Four examines the subject of regulation of Brussels I bis, lists the types of jurisdictions and looks at its specifics.
