Limitující faktory protiteroristických mechanismů Evropské unie

Abstract

The basis, upon which this thesis has been built, are the two following trends: occurence of terrorist attacks in the EU and creation of new counter-terrorism institutions on the EU level. A frequency of both trends has been rising: the occurence of terrorist attacks on the EU territory has increased despite the closer cooperation in security and counter-terrorism area that can manifested by adopting new measures and designing new institutions. Therefore, the author asks a question: What factors are hindering a better functioning of the EU counter-terrorism mechanisms? The six most significant EU counter-terrorism institutions with exclusively or overwhelmingly counter-terrorism mandate is subjected to analysis. The respective limits of their functioning have been subsumed to a classification that was created by the author using the general institutional theory, in particular the theory of regimes. The attention is given to an interplay between the EU counter-terrorism bodies and their counterparts on the national level. In case of every institution that has been explored, the author evaluates the following criteria. Východiskem práce jsou dva probíhající trendy: výskyt teroristických útoků v Evropské unii a vytváření protiteroristických institucí na úrovni Evropské unie. Oba trendy mají narůstající výskyt: teroristických útoků na území EU přibývá navzdory stale užší spolupráci na unijní úrovni v bezpečnostní a protiteroristické oblasti, která se projevuje vytvářením nových opatření a orgánů. Autor si proto klade otázku, jaké faktory brání lepšímu fungování unijních protiteroristických mechanismů. Analýze je podrobeno šest nejvýznamnějších institucí s výlučně či převážně protiteroristickým mandátem. Jednotlivé limity jejich fungování autor zařazuje do vlastní klasifikace, kterou vytvořil na základě obecné institucionální teorie, konkrétně teorie režimů. Pozornost je soustředěna především na modus operandi mezi protiteroristickými orgány EU a jejich protějšky na národní úrovni, v rámci jednotlivých členských států. U každé ze zkoumaných institucí tak vyhodnocuje následující kritéria. Zaprvé, přítomnost ustáleného jednání ve smyslu spolupráce orgánů členských zemí s unijními protiteroristickými institucemi. Zadruhé, subjektivní vnímání této spolupráce ze strany národních orgánů jako žádoucí a potřebné. Zatřetí, vymahatelnost této spolupráce ze strany unijních orgánů.
