Vybraná omezení práva na informace

Abstract

Právo na informace je dnes neodmyslitelným atributem demokratického právního státu sloužící jako nástroj kontroly veřejné moci. Toto právo však není neomezitelné a naráží tak na řadu omezení. Tato práce si bere za úkol některá z těchto omezení blíže prozkoumat. Diplomová práce je tvořena třemi kapitoly, přičemž její jádro se nachází v kapitole třetí, která se dělí na tři podkapitoly. Předmětem každé podkapitoly je vždy jednotlivé omezení práva na informace. První kapitola pojednává o samotném pojmu práva na informace a zmiňuje jeho historickou provázanost se svobodou projevu. Závěr první podkapitoly je věnován právnímu zakotvení práva na informace v České republice. Druhá kapitola pojednává o obecných hlediscích omezení práva na informace. Zmíněny jsou jednotlivá ústavní i zákonná ustavení týkající se možného omezení práva na informace, rovněž jsou zmíněna i některá významná rozhodnutí Evropského soudu pro lidská práva ve Štrasburku v předmětné oblasti. Třetí kapitola se dělí na tři podkapitoly. V každé podkapitole se práce zaměřuje na jednotlivé omezení práva na informace. Cílem první podkapitole je seznámit čtenáře s problematikou poskytování informací o platech zaměstnanců placených z veřejných prostředků. The right to obtain information is now an essential attribute of any democratic state serving as a tool for control of public authority. This right is not illimitable and alludes to a number of limitations. The aim of this paper is to take a closer look on some of these limitations. The paper consists of three chapters while its core is in the third chapter, which is divided into three subchapters. The topic of each subchapter is always different restriction on the right to obtain information. The first chapter deals with the very concept of the right to obtain information and mentions its historical ties to the freedom of speech. Ending of the first chapter is aboutlegal grounds of the right to obtain information in the Czech Republic. The second chapter is about general aspects of restrictions on the right to obtain information. Various constitutional and legal provisions on the possible restrictions on the right to obtain information are mentioned as well as some important decisions of the European Court of Human Rights in Strasbourg.
