Možnosti regulace "nových psychoaktivních látek" na území České republiky

Abstract

Po roce 2010 se v České republice, stejně jako v ostatních státech Evropy a celého světa, začínají ve větší míře objevovat látky, které mají podobné účinky jako drogy opiátového a stimulačního typu, ale pro svoji "novost" nejsou kontrolovány žádnou legislativou. Cílem této práce je posouzení, zda v současném stavu tohoto jevu jedná o problém, který by měl být politicky řešen, včetně posouzení jeho rozsahu. Na základě výsledků této analýzy budou zhodnoceny současné možnosti řešení tohoto problému se zaměřením na oblast regulace. Práce si zároveň klade za cíl identifikovat odlišné perspektivy mezi odborníky drogové problematiky a porozumět jejich zapojení do procesu tvorby drogové politiky České republiky v oblasti těchto látek. V první části práce je kvalitativní metodou obsahové analýzy dokumentů popsána současná situace v oblasti nových psychoaktivních látek v České republice a jsou zde představeny současné legislativní přístupy používané na národní i mezinárodní úrovni. Ve výzkumné části byla použita kvalitativní metoda výzkumu (polostrukturované rozhovory s odborníky v oblasti drogové problematiky) a provedeným výzkumem bylo zjištěno, že nové psychoaktivní látky jsou napříč odbornou společností vnímány jako problém, jehož míra však nedosahuje takové intenzity jako v jiných státech Evropské unie. After 2010, substances that have similar effects as opiate drugs and stimulant drugs started to appear in the Czech Republic as well as in other European countries and around the world, however they are not controlled by any legislation because of their "newness". The aim of this study is to evaluate whether under the current circumstances this is a problem that should be solved politically, including the assessment of its extent. The current solutions to this problem focused on its regulation shall be assessed on the basis of the results of this analysis. The thesis also aims to identify different perspectives of the drugs issue experts and to understand their involvement in the process of making the drug policy of the Czech Republic concerning these substances. The first part describes the current situation in the field of new psychoactive substances in the Czech Republic using a qualitative method of the documentary content analysis, and introduces the legislative approaches currently used at both national and international level.
