Střídavá péče v rodinách s historií domácího násilí

Abstract

Tématem této bakalářské práce je institut střídavé péče v kontextu problematiky rodin s historií domácího násilí. V teoretické části jsou popsány hlavní charakteristiky střídavé péče, podmínky pro její nařízení soudem a základní legislativní rámce, ze kterých vychází. Pozornost je věnována také zastáncům respektive odpůrcům této formy porozvodového uspořádání výchovných poměrů k nezletilému dítěti. Čtenář je seznámen se specifiky domácího násilí, jeho dynamikou a vlivem na dítě v rodině. V závěru teoretické části jsou popsány formy možných řešení, které si existence domácího násilí ve spojení s institutem střídavé péče vyžaduje. Praktická část se zabývá kazuistikami rodin s historií domácího násilí, v nichž došlo na základě soudního rozhodnutí k aplikaci střídavé péče o nezletilé děti.

The theme of this bachelor's thesis is the issue of joint custody in a context of problems of families with a history of domestic violence. The theoretical part describes the main characteristics of joint custody, the conditions for its court order and the basic legislative frameworks on which it's based. Attention is also paid to the proponents or opponents of this form of child care in the post-divorce period. The reader is introduced to the specifics of domestic violence, its dynamics and impact on a child in a family. In the end of the theoretical part are described some of the forms of possible solutions that the existence of domestice violence in conjuction with the joint custody requires. The practical part deals with case studies of families with a history of domestic violence in which was applied the joint custody on the basis of a court decision.
