Abstract

Determination of Parenthood (Abstract) The determination of parenthood is undoubtedly a very topical issue. There are significant changes which are consequences of modern society approach to the family life as well as of massive progress in the field of medical science and genetics. The development in these areas has brought new concepts such as baby-boxes, assisted reproduction and surrogacy. Now it is up to the legislation to provide rules within the legal framework for these new institutions to steady parental relationships and to secure their protection as well. The aim of this thesis is to familiarize the reader with Czech legal regulation of determination of parenthood by means of its description and analysis. Another aim of the work is to compare this legal regulation with regulation in other countries, in particular in Germany and to find similarities and differences between them. Finally the thesis highlights new institutions within determination of parenthood. This thesis consists of nine chapters which deal with particular parts of its subject-matter. The opening chapter discusses the relationship between a parent and a child both theoretically and historically. Určování rodičovství (Abstrakt) Určování rodičovství je nepochybně velmi aktuálním tématem. Probíhá zde mnoho významných změn, které jsou důsledkem jak pojetí rodinného života v moderní společnosti, tak obrovského pokroku na poli lékařské vědy a genetiky. Vývoj v těchto oblastech s sebou přinesl nové koncepty jako babyboxy, asistovanou reprodukci a náhradní mateřství. Nyní je věcí zákonodárce pro tyto nové instituty poskytnout pravidla v rámci právního řádu tak, aby byly stabilizovány rodičovské vztahy a zajištěna jejich ochrana. Cílem této diplomové práce je seznámit čtenáře s českou právní úpravou určování rodičovství cestou jejího popisu a analýzy. Druhým cílem této práce je porovnat tuto právní úpravu s úpravou v jiných zemích obzvláště v Německu a najít mezi nimi shody a rozdíly. Konečně práce zdůrazňuje rovněž nové instituty v rámci určování rodičovství. Skládá se z devíti kapitol, které se zabývají jednotlivými částmi jejího předmětu. Úvodní kapitola pojednává o vztahu mezi rodičem a dítětem jak teoreticky, tak historicky. Kromě toho popisuje také právní předpisy aplikované v České republice a v Německu v průběhu času.
