Eurojust a instituce trestní spolupráce EU

Abstract

This thesis analyzes Eurojust (The European Union's Judicial Cooperation Unit) and its relations with other institutions of European cooperation in criminal matters such as Europol (European Police Office), OLAF (European Anti-Fraud Office), European Judicial Network and educational institutions- European Judicial Training Network (EJTN) and European Police College (CEPOL). The first chapter deals with general information about judicial and police cooperation in criminal matters in the EU. It summarizes its history and discusses differences between the first and third pillar of the European Union and mentions the changes after adoption of the Lisbon Treaty which abolished the pillar structure. And thus communitarization of the third pillar has been made that has allowed deeper cooperation in criminal matters in the EU. Chapter Two describes Eurojust as a crucial institution of judicial cooperation in criminal matters in the EU. There is presented the history of Eurojust, its mission, tasks and organizational structure. The last part of this chapter is about the future of The European Union's Judicial Cooperation Unit, especially focuses on the possibility of establishing the European Public Prosecutor's Office from Eurojust. Tato diplomová práce podává výklad o Eurojustu (Evropské jednotce pro justiční spolupráci) a o jeho vztazích s jinými institucemi evropské spolupráce v trestních věcech, jako jsou Europol (Evropský policejní úřad), OLAF (Evropský úřad pro boj proti podvodům), Evropská justiční síť a vzdělávací instituce- Evropská síť pro justiční vzdělávání (EJTN) a Evropská policejní akademie (CEPOL). V úvodní kapitole je pojednáno o justiční a policejní spolupráci v trestních věcech v EU. Je shrnuta její historie a jsou rozebrány rozdíly mezi prvním a třetím pilířem Evropské unie. Dále jsou zmíněny změny vyplývající z přijetí Lisabonské smlouvy, která zrušila pilířovou strukturu, a tím došlo ke komunitarizaci třetího pilíře. To umožňuje hlubší trestní spolupráci v Evropské unii. Druhá kapitola se zaměřuje na Eurojust, který je stěžejní institucí justiční spolupráce v trestních věcech. Pojednává o jeho historii, cílech, úkolech a organizační struktuře. V poslední části této kapitoly jsou nastíněny možnosti budoucího vývoje Eurojustu, zejména pak možnost přeměny Eurojustu v Úřad evropského veřejného žalobce, který by mohl podávat obžalobu a zastupovat ji před soudy.
