Právní aspekty národní a mezinárodní ochrany kytovců Severního moře

Abstract

Tématem této diplomové práce je ochrana kytovců Severniho moře. Hlavním cílem práce je určení, jakým způsobem přispívá právo k ochraně těchto živočichů, a pojmenování nejdůležitějších instrumentů práva, které pomáhají kytovce chránit. Jde o právní prameny na úrovni národní, subregionální a regionální, ale i na úrovni mezinárodní. Pro ochranu kytovců je nezbytné znát jejich přirozený způsob života a chování a vědět o nebezpečích, kterým musí čelit a jak jim je možno zabránit. Práce je rozdělena na šest částí. První dvě části představují úvod do problematiky věnovaný obecným a věcným souvislostem ochrany kytovců. Zabývají se biologickými souvislostmi, významem ochrany druhů i biodiverzity, příčinami a formami ohrožení kytovců, stručně rekapitulují historický vývoj lovu kytovců a počátky jejich ochrany. Doplněním ve třetí části je rozbor právního režimu, resp. režimů biologických mořských zdrojů, které jsou pro ochranu mořské biodiverzity určující, a mezinárodněprávní základ ochrany mořské biodiverzity. Přestože je má práce zaměřená na ochranu kytovců Severního moře, těžištěm jejich ochrany jsou dvě globální mezinárodní úmluvy, na jejichž základě probíhá v současné době veškerý lov kytovců i obchod s nimi, Mezinárodní úmluva o regulaci velrybářství a Úmluva o mezinárodním obchodu s ohroženými druhy...

Legal Aspects of National and International North Sea Conservation of Cetaceans Presented diploma thesis focuses on the protection and conservation of cetaceans in the North Sea. The main goal of this paper is to determine how law contributes to the protection of these creatures, to name the most important instruments that help to protect cetaceans at international, regional, subregional and national levels. For protection of cetaceans it is also necessary to identify the natural way of life and behavior of these animals and to learn more about the dangers they face and how they can be prevented. The thesis is divided into six parts. The first two parts are devoted to introduction to general biological and factual context of the protection of cetaceans and recapitulate the historical process of whaling and the dawn of their protection. The third chapter briefly summarizes legal regime of the sea and regime of living marine resources that is decisive for their protection and describes an international background of the marine biodiversity protection.
