Zásada poctivého obchodního styku

Abstract

Autor diplomové práce zkoumá filosofické a historické základy zásad poctivého obchodního styku v českém právu. V další partiích diplomové práce autor provádí analýzu pojmového obsahu zásad poctivého obchodního styku s ohledem na aktuální judikaturu a srovnání pojmů dobrých mravů a zásad poctivého obchodního styku. Autor rovněž poukazuje na některá kontroverzní rozhodnutí českých soudů ve vztahu k zásadám poctivého obchodního styku.

The author of the thesis analyses philosofical and historical grounds of the principle of fair business transactions in the Czech law. In the other parts of the thesis the author analyses the notion of the principle of fair business transactions with respect to the actual case law of the Czech courts and compares the notions of good manners and principle of fair business transactions. The author also outlines some controversial decisions of the Czech courts in relation to principles of fair business transactions.
