Dokončení vnitřního trhu EU v oblasti služeb

Abstract

This thesis is devoted to complex analysis of the service sector within the EU internal market. The first chapter deals with definition of the internal market and position of service sector within this market. Further it scatches the international liberalization of services and the role of EU in the (GATS) proces. Because the service sector permanently developes and inovates I felt as neccsary to deal with the categorisation issue in the second chapter. Here I also define the sectors for further exam ination in the thesis. In the third chaptre this individual sectors are described. This is done from the perspective of their importance within the internal market as well as from the perspective of the legislative activity of the European Community in these sectors. Important chapter is chapter no. 4 in which are described the bariers in provision (cross boarder) of services within the internal market. The following chapter describes the legislative activity of the European Community (primary law and strategic papers). Here, the most important part is the description of the last draft propsal of the service directive. Ve své diplomové práci komplexně pojednávám problematiku dokončení vnitřním trhu EU v oblasti služeb. První kapitola je zasvěcena vymezení pojmu vnitřního trhu a významu služeb na něm. Načrtávám také problematiku liberalizace služeb v mezinárodním, resp. globálním kontextu a přístupu EU v rámci vyjednávání o liberalizaci světového obchodu se službami (GATS). Vzhledem к tomu, že se sektor poskytování služeb dynamicky vyvíjí a proměňuje, věnuji se v druhé kapitole přístupům к jeho kategorizaci. Dále pak definuji oblasti služeb, které pro účely práce siřeji popisuji. Ve třetí kapitole tak přibližuji definované sektory. U každé z těchto kategorií rámcově popisuji jak pozici a význam z hlediska vnitřního trhu, tak legislativní aktivitu Společenství. Důležitou kapitolou je kapitola č. 4, ve které se věnuji překážkám v poskytování služeb na vnitřním trhu, zejména pak regulacím a kulturním a jazykovým překážkám. V následující kapitole shrnuji legislativní aktivitu (primární právo a strategické dokumenty) Společenství. Zde je nejvýznamnější detailní rozbor posledního návrhu směrnice o službách. V předposledních dvou kapitolách se věnuji shrnutí negativ rozdrobeného trhu se službami a přínosům spojeným s jeho dokončením.
