Abstract

The Methodics of Investigation of the Sexual Crime Acts (chosen issues) Key words: rape, sexual abuse, investigation Summary This submitted diploma thesis deals with procedures of investigation of crimes rape and sexual abuse, which are two most serious offences within sexual criminal acts. In this work I analyze only some of the most essential moments of investigation, because the theme as a whole exceeds the required extent of the diploma thesis. Most attention is paid to contacts of the prosecuting and adjudicating bodies with the victim and to the acts in which the victim is involved. The introductory part analyzes basic contemporary and prospective legal regulation of all sexual criminal acts given in the present and new criminal codes. Offences of rape and sexual abuse are explicated in more detail. Then the work brings a criminalistic characteristics of these offences with basic statistical data. It points out the decreasing detection rate of these crimes over the last few years. Within the criminalistic characteristics, the thesis shows typical ways of committing these crimes, typical offenders, victims and typical traces. Podstatnou ástí této práce je zpracování p ípadu ze skute ného vyšet ovacího spisu (kapitola 4.1 - Krysa), na kterém lze pozorovat práci policie p i vyšet ování a porovnávat ji s teoretickými poznatky z kapitol p edcházejících. Zvolený p ípad není typickým, se kterým se policie asto setkává, nebo , jak bylo výše vyloženo, v tšina znásiln ní má pr b h odlišný od brutálního p epadení a znásiln ní cizím mužem na odlehlém míst . I p esto jsem tento p ípad do práce za adil, protože pr b h vyšet ování i jeho výsledek je zajímavým a policie p i n m využila prakticky všechny postupy a metody uvedené v kapitole 2 (jsou zde r zné podn ty pro zahájení vyšet ování od oznámení ob tí po oznámení anonymním telefonním hovorem, ohledání místa inu i t la ob ti, lze sledovat jaké vyšet ovací verze policie na po átku vyšet ování stanovila a také byly provedeny výslechy, rekognice, expertizy i použita psychologická podpora - psychologický profil pachatele). Co z výkladu kapitoly 4.1 nevyplývá je, že jednotlivá p epadení a znásiln ní, resp. pokus, byla vyšet ována z po átku jako samostatné p ípady na úrovni p íslušných obvodních editelství policie...
