Aktuálne otázky regulácie medzinárodnej leteckej prepravy

Abstract

Problematika medzinárodnej leteckej prepravy je mimoriadne rozsiahla, no zároveň mimoriadne zaujímavá téma. Vo svojej práci som sa preto zamerala len na niektoré jej aspekty, ktoré som sa pokúsila popísať a pokiaľ možno i zatriediť do širších súvislostí. Aj napriek tomu som však u niektorých otázok podala len základnú charakteristiku (napríklad v oblasti nariadení ES/EÚ týkajúcich sa leteckej dopravy), mnohým oblastiam som vzhľadom na obmedzený rozsah práce nevenovala vôbec. Ide napríklad o problematiku medzinárodných organizácií a združení v civilnom letectve, t.j. medzinárodné medzivládne a medzinárodné nevládne organizácie.212 Po úvodnej kapitole som sa najprv pokúsila vymedziť kľúčové pojmy v oblasti leteckej dopravy, resp. prepravy. Okrem iného práve rozdiel medzi týmito dvoma termínmi, ktoré sú v bežnej reči často zamieňané. V ďalšej podkapitole som veľmi stručne vymedzila najčastejšie zmluvné typy prostredníctvom ktorých sa uskutočňujú vzťahy medzi leteckým dopravcom a ďalšími osobami. Vzhľadom na to, že vo štvrtej kapitole sa budem venovať aj priamej úprave prepravnej zmluvy, považovala som za vhodné spomenúť i kolíznu úpravu tejto problematiky a to ako existujúcu (ZMPS a Rímsky dohovor), tak i budúcu (nariadenie "Rím I"). The purpose of my thesis is to analyse legal regulation of international air transport. The reason for my research is that in my point of view this is very important part of international relations which develop rapidly. So there is a great deal of news from last few years and some of them I try to describe and analyse. The thesis is composed of six chapters, each of them dealing with different aspects of air carriage. Chapter Two is introductory and defines the basic terminology used in the thesis concerning air carriage. The chapter is subdivided into two parts. Part One differences between carriage and transport, between scheduled and non-scheduled transport, describes air carriage, airport, civil aviation and so on. Part Two deals with the main transportation contracts' types used in international commercial relations. It provides a brief description of those types. Chapter Three describes the methods used in regulation of civil legal relationships with international element. The chapter consists of four parts. Part One focuses on conflict rules. Part Two investigates the second type of method used - "direct method" of regulation. Part Three describes a relation between these two types of regulation.
