Trest zákazu činnosti a jeho kontrola

Abstract

Resumé Tato diplomová práce se zabývá trestem zákazu činnosti, jeho výkonem, kontrolou a souvisejícími instituty. Jejím hlavním cílem vymezeným v Úvodu je ucelené shrnutí dané problematiky se zaměřením na rozhodovací praxi českých soudů. Samotný text je rozdělen na jedenáct kapitol, z nichž některé se dále dělí na podkapitoly. V Závěru shrnuji a hodnotím výsledky práce. Vedle toho práce zahrnuje Obsah, Seznam zkratek a Seznam použité literatury. První kapitola je věnována obecné problematice trestu a člení se do čtyř podkapitol. První podkapitola shrnuje pojem trestu, druhá vysvětluje podstatu trestu zákazu činnosti. Třetí podkapitola rozebírá účel trestu. Čtvrtá podkapitola se zaměřuje na účel trestu zákazu činnosti. Druhá kapitola sleduje postavení trestu zákazu činnosti v systému trestů v českém právu. Třetí kapitola se vztahuje k tématu alternativních trestů a je členěna na tři podkapitoly. První podkapitola popisuje pojem alternativních trestů v obecném slova smyslu, druhá shrnuje příčiny jejich vzniku a třetí podkapitola ukazuje trest zákazu činnosti jako alternativní trest. Čtvrtá kapitola shrnuje historický vývoj trestu zákazu činnosti na českém území. This thesis focuses on the punishment of disqualification, as well as on its execution, control and related institutes. The main objective of the thesis defined in the Introduction is making a comprehensive summary of the issue with a focus on decision- making practice of the Czech courts. The text itself is divided into eleven chapters, some of which are divided into subchapters. In the Conclusion, the results of my thesis are summarized and evaluated. Besides that the thesis includes Content, Index of Abbreviations and Bibliography. The first chapter deals with general term of the punishment and it is divided into four parts. The first subchapter summarizes the concept of a punishment; the second one explains the nature of the punishment of disqualification. The third subchapter analyses the purpose of a punishment. The fourth subchapter focuses on the purpose of the punishment of disqualification. The second chapter explicates the status of the punishment of disqualification in the Czech penal system of penalties. The third chapter covers the topic of alternative punishments and it is divided into three subchapters.
