Abstract

Vinohradnictví a vinařství z pohledu práva Abstrakt Tato diplomová práce je především teoretickým pojednáním o právní regulaci vinohradnictví a vinařství v ČR. Jejím cílem je seznámit čtenáře s platnou právní úpravou nejdůležitějších institutů obou oblastí podle zákona č. 321/2004 Sb. o vinohradnictví a vinařství, ale i jiných zákonů a pramenů práva s ohledem na právní předpisy EU. Důraz je kladen na jednotlivé aspekty vinohradnické činnosti a následné výroby vinařských produktů a také podmínky pro jejich uvádění do oběhu. Práce je členěna do celkem 8 kapitol, včetně úvodu a závěru. Úvodní kapitoly jsou zaměřeny na vymezení postavení úpravy vinohradnictví a vinařství v právním řádu ČR a ujasnění vztahů mezi jednotlivými prameny práva obou oblastí v kontextu legislativy EU. Stěžejní část práce je obsažena v kapitolách č. 3 a č. 4, které jsou věnovány aktuální právní úpravě oblasti vinohradnictví a vnařství. Vinohradnická část práce je zaměřena především na regulaci výsadby vinné révy a některých aspektů rostlinolékařské péče a hnojení, které s vinohradnickou činností úzce souvisí. V odvětví vinařství je důraz kladen na enologické postupy, klasifikaci vinařských produktů, označování a ztříďování vín. Viniculture and wine-making from a legal viewpoint Abstract This thesis is primarily a theoretical treatise on the legal regulation of viticulture and wine-making in the Czech Republic. It aims to provide an overview of the current legal regulation of the most important institutes of both aforementioned fields, focusing on the Act No. 321/2004 Coll. on viniculture and winemaking, but also other laws and sources of law with regard to EU legislation. Emphasis is placed on the individual aspects of viticultural activity and the subsequent manufacturing of wine products and the conditions for their marketing. This thesis is divided into 8 chapters, including an introduction and a conclusion. The introductory chapters are focused on defining the position of the wine law in the legal system of the Czech Republic and clarifying the relations between the sources of law of viticulture and wine-making in the context of EU legislation. The main body of this thesis is included in chapters No. 3 and No. 4. These chapters are devoted to the current legislation in the field of viticulture and wine-making.
