Justiční a policejní spolupráce v Evropské unii

Abstract

V souvislosti s postupující integrací Evropské unie a užší spoluprací členských států v oblasti trestního práva procesního jsou v současné době jak orgány činné v trestním řízení, tak další osoby na trestním řízení zúčastněné, vystaveny řadě nově nastolených výzev a dosud nezodpovězených otázek. V posledních několika letech na půdě Evropské unie vzniklo mnoho nových institucí a byla přijata řada právních nástrojů, které mají přímý vliv na spolupráci mezi justičními a policejními orgány jednotlivých zemí. V návaznosti na nově vznikající druhy kriminality a celkově provázanější spolupráci pachatelů závažné trestné činnosti, se příslušné orgány na unijní i na národní úrovni setkávají se situacemi, které zatím nebyly řešeny buď vůbec, nebo které jsou zatím upraveny pouze teoretickými normami, dosud neuvedenými do praxe. Vzhledem k různorodosti a četnosti právních nástrojů a institucí, které zasahují do trestněprávní sféry, aniž by v mnoha případech byla jakkoliv upravena jejich vzájemná kooperace či vyřešena otázka aplikační přednosti, považuje autorka této práce za účelné představit odborné veřejnosti ucelený pohled na danou problematiku a definovat a shrnout všechny podstatné právní nástroje a instituce, které se danou problematikou na půdě Evropské unie zabývají. The criminal justice as well as the persons participating in criminal proceedings, they both are currently facing number of newly posed challenges and unanswered questions so far, due to the onward going integration of the European Union and much closer cooperation of the Member States, in the field of the Procedural Criminal Law. There have been established many new institutions within the field of the European Union in last few years and there were adopted many legal tools which directly influence the cooperation between the judicial and police authorities of individual countries. In connection with newly emerging forms of the crime and more coherent cooperation of the perpetrators of severe crime, the relevant authorities at the union level as well as at the national level encounter situations not being resolved at all, or which are specified by theoretical standards only and have not been put into practice yet.
