Public Prosecutor, Preliminary Criminal Proceedings, Diversions in Criminal ProceedingsTématem předkládané diplomové práce je "Role státního zástupce v trestním řízení". Je to státní zastupitelství, kterému je v České republice na základě Ústavy uloženo zastupovat veřejnou žalobu. Těžištěm činnosti státních zástupců je tedy jejich účast na trestním řízení a činnosti s ní spojené. Tato práce si tudíž klade za cíl v prvé řadě předložit popis těchto činností, a to chronologicky a podle jednotlivých stádií, kterými trestní řízení prochází. Dalším cílem je poté pozastavit se nad některými úskalími v právní úpravě státního zastupitelství či oblastmi jevícími se v praxi jako problematické, zamyslet se nad jejich možnými důvody a navrhnout řešení dle lege ferenda. V jiných případech také zhodnotit recentní změny právní úpravy a předložit úvahu o jejich možných důsledcích. Kapitola první je věnována vzniku a stručnému vývoji veřejné žaloby v kontinentální Evropě a pak konkrétněji i v českých zemích. Tuto kapitolu lze vnímat jako jakýsi úvod do problematiky činností státního zastupitelství v trestním řízení, jelikož studiem jejich historie zjišťujeme, na základě jakých úvah a zásad byl současný systém vybudován. Druhá kapitola se věnuje právní úpravě působnosti státního zastupitelství. Zprvu je probráno jeho ústavní zakotvení včetně z něj pramenící otázky, zda je státní zastupitelství orgánem...
The title of this diploma thesis is "The Role of a Public Prosecutor in Criminal Proceedings". In the Czech Republic, it is Public Prosecution that is granted the right by the Constitution to prosecute criminal offenses on behalf of the country. Activities arising from this right are the main duties of a public prosecutor. The aim of this thesis is therefore to describe said activities. It is done so chronologically with regard to the different phases of criminal proceedings. Other goals include trying to find problematic areas of the laws that govern public prosecutors, trying to come up with possible reasons behind them and proposing their solutions. This thesis also contains comments on some of the recent changes in the rules governing public prosecution. The first chapter of this thesis contains a brief history and evolution of public prosecution in Central Europe and in the Czech lands as the author believes it is a very useful introduction to public prosecution and its role in criminal proceedings today. Chapter two of this thesis deals with the laws governing public prosecution. First, the Constitution is mentioned including its article 80 and its problematic placement within the Constitution.
