Abstract

Odpovědnost za škodu způsobenou autonomním dopravním prostředkem Abstrakt Autonomní dopravní prostředky jsou již několik let jedním z nejzajímavějších témat, které se pojí s příchodem Průmyslu 4.0 a rozšířením umělé inteligence ve společnosti. Tato diplomová práce se proto zabývá tématem autonomních dopravních prostředků coby podmnožinou autonomních systémů, a to konkrétně ve spojení s občanskoprávní odpovědností. Je pravděpodobné, že v budoucnu bude dojde k masivnímu rozšíření autonomních dopravních prostředků ve společnosti, a nelze vyloučit, že vzniknou situace, kdy v důsledku jejich nastavení dojde ke vzniku újmy. Cílem této diplomové práce je proto uvést modely odpovědnosti, jejichž využitím se právní věda v souvislosti s autonomními dopravními prostředky zabývá, a posoudit možnost aplikace současných institutů občanského zákoníku s cílem nalezení vhodného budoucího řešení. Za tímto účelem se práce nejdříve věnuje pojetí autonomního dopravního prostředku dle občanského zákoníku a jiných právních předpisů a za pomocí dosavadních definic umělé inteligence se zabývá specifickými vlastnostmi autonomních systémů, jakož i postavením konkrétních osob spojených s provozem autonomních dopravních prostředků ve světle současné právní úpravy, jejich typologií a podmínkám jejich provozu samotného. Liability for damages caused by an autonomous vehicle Abstract For several years now, autonomous vehicles have been one of the most interesting topics associated with the upcoming Industry 4.0 and the spread of artificial intelligence in society. This thesis therefore deals with the topic of autonomous vehicles as a subset of autonomous systems, specifically in connection with civil-law liability. It is probable that in the future there will be a massive expansion of autonomous means of transport in society, and it cannot be ruled out that a situation will arise where their setting will result in damage. The aim of this thesis is to present the models of liability, the use of which is discussed by jurisprudence in connection with autonomous vehicles, and to assess the possibility of using the current institutes of Civil Code, to find a suitable future solution.
