Information society provider, Information society service, Responsibility for the foreign content, Hosting, Safe harbour, Monitoring and filtering, Author's rights, Communication to the public, Digital single marketDiplomová práce pojednává o podmínkách vzniku, rozsahu, omezení a vyloučení odpovědnosti poskytovatelů služeb informační společnosti (ISP) typu hosting za cizí obsah v kontextu autorského práva a práv souvisejících s právem autorským, zejména v kontextu se sdělováním díla veřejnosti. V práci jsou na různých místech vymezeny relevantní právní ustanovení, které jsou následně podrobeny kritické analýze. Pozornost je věnována zejména institutu bezpečného přístavu s ohledem na účinnou právní úpravu, judikatorní praxi a jeho dopadům na poskytovatele služeb informační společnosti.
The thesis deals with conditions of the emergence, extent, limitation and exclusion of the responsibility of the hosting type information society providers (ISP) for the foreign content, within the context of the communication to the public of the copyrighted work. The relevant provisions of national law are specified and critically analysed in the thesis. The thesis focuses on the legal construct of the safe harbour and impacts on the information society providers, considering the effective laws and the case law of the courts.
