Abstract

Povinné subjekty dle zákona č. 106/1999 Sb. Abstrakt V úvodu své práce jsem si vytyčila cíl poskytnout komplexní přehled o subjektech podléhajících informační povinnosti dle informačního zákona. V průběhu načítání podkladů jsem se seznámila s množstvím soudních rozhodnutí, legislativních dokumentů a odborné literatury, přičemž tyto poznatky jsem se pokusila aktivně začlenit a komentovat v textu své práce tak, abych co nejvěrněji vykreslila tendence v jednotlivých sporných částech této problematiky. V první kapitole poskytuji rozbor pojmu "informace" dle informačního zákona v porovnání s pojmem "utajená informace" dle návrhu novely zákona č. 412/2005 Sb.. Ve druhá kapitole jsem nastínila mezinárodní kontext práva na informace, především z pohledu Všeobecné deklarace lidských práv, Mezinárodního paktu o občanských a politických právech, Úmluvy o ochraně lidských práv a základních svobod. Třetí kapitola popisuje ústavněprávní vymezení práva na informace v kontextu českého právního řádu, resp. Listiny základních práv a svobod a jejího čl. 17, který tvoří základ ústavního informačního práva v České republice. Persons Subject to Duty under Act. No. 106/1999 Coll. Abstract At the beginning of my thesis I set myself a goal to provide a comprehensive overview of Persons Subject to Duty under Act. No. 106/1999. Coll. Druing the reading of materials, I became acquainted with a number of court decisions, legislative documents and professional literature. I tried to incorporate these findings in the text of my work, comment them and so as to illustrate the tendencies in the individual controversial parts of this issue. In the firsth chapter I provide an analysis of the term "information" according to the Act. No 106/1999 Coll. In comparison with the term "classified information" according to the draft amendment Act. No. 412/2005 Coll. In the second chapter I outlined the international context of the right for information, especially from the perspective of the Universal Declaration of the Human Rights, the International Covenant on Civil and political Rights, the Convention for the Protection of Human Rights and Fundamental Freedoms.
