detention proceedings, involuntary hospitalization, medical restraintsDetenční řízení v České republice Abstrakt Rigorózní práce Detenční řízení v České republice se zabývá účinnou hmotněprávní i procesněprávní úpravou řízení ve věcech vyslovení přípustnosti převzetí nebo držení ve zdravotním ústavu, které je zkráceně označováno jako detenční řízení. Pojednává tedy zejména o řízeních, která jsou vedena ohledně osob, které byly bez svého souhlasu hospitalizovány ve zdravotním ústavu a také o řízeních o posouzení zákonnosti omezení osoby hospitalizované se svým souhlasem ve volném pohybu nebo ve styku s vnějším světem omezovacími prostředky. Práce je rozdělena do dvou hlavních částí a třetí části, která obsahuje úvahy de lege ferenda. První část práce je zaměřena na východiska detenčního řízení obsažená v mezinárodních úmluvách a v ústavním pořádku České republiky, dále se zaměřuje na právní úpravu detenčního řízení de lege lata v občanském zákoníku, v zákoně o zdravotních službách a v zákoně o zvláštních řízeních soudních. Práce podrobně rozebírá jednotlivé druhy a jednotlivé fáze detenčního řízení, a to jak z pohledu teorie, tak z pohledu praxe, když jsou v práci reflektovány praktické zkušenosti s detenčním řízením z pozice asistenta soudce zabývajícího se touto agendou. Detention Proceedings in the Czech Republic Abstract The thesis Detention Proceedings in the Czech Republic is focused on the effective substantial and procedural legal regulation of the proceedings held to assess the legality of patient's admission to the health-care institution without its consent, which is summarily called the detention proceedings. The thesis therefore concentrates mainly on the proceedings held about individuals hospitalized without their consent and also about the proceedings held to assess the legality of restrains on liberty of the patient hospitalized with granted consent. The thesis is divided into two main parts and contains also the third part with de lege ferenda thoughts. The first part is focused on the bases of detention proceedings contained in international covenants or treaties and in the constitutional order of the Czech Republic, further it is concerned with de lege lata legal regulation in the Civil Code, in the Act on Healthcare Services and in the Act on Special Court Procedures. The thesis closely analyses the different types and phases of the detention proceedings, theoretically as well as practically, as it reflects practical experience of an assistant of a judge involved in the proceedings.
