copyright, performer, variety and circus artist, performance, Copyright actTato dizertační práce podává systematický výklad práva umělecko-interpretačního jakožto účelově vymezeného souboru právních norem upravujících právní poměry týkající se uměleckých výkonů. Autor argumentuje ve prospěch právní ochrany uměleckého výkonu, kterou považuje za zvláštní projev osobnostněprávní ochrany vyvěrající z přirozenoprávního pohledu na osobnost umělce - autor tedy nesouhlasí s těmi přístupy, které v právní ochraně výkonného umělce shledávají pouze aspekty soutěžněprávní ve smyslu ochrany investice. Přitom ale nelze na výkonné umělce mechanicky aplikovat právo autorské, neboť zde existují i důvodné rozdíly - výkonný umělec především netvoří žádné nové dílo, jímž by obohacoval poznání lidstva, pouze individuálně provádí existující umělecké dílo - společenský přínos autorské tvorby je zde tedy vyšší a autor polemizuje s možností subsumpce ochrany uměleckého výkonu pod čl. 34 odst. 1 Listiny. Přesto je však ochrana uměleckého výkonu nezbytná, neboť společnost potřebuje nejenom to, aby autorská tvorba existovala, ale též aby byla prováděna, pokud má existovat živé umění. Dnes, když je živé umění ohrožováno více než kdy jindy technologiemi umožňujícími konzumaci umění ve virtuální realitě či umožňujícími nahradit výkon herce v audiovizi jeho digitálním substitutem, význam právní ochrany...
The thesis offers a systematic overview of the law of performers' rights. This specific field of law forms no major area of law by itself, but rather covers various legal regulations that are related to artistic performances. The author argues for specific protection of an artistic performance which emanates from the protection of a persona as it is understood by the theory of natural law. The author thus opposes those who consider the protection of a performer to be only a protection of an investment in the economic competition. That being said, it is impossible to automatically apply authors' rights to performers because of numerous differences between the two. The performer is not creating a new work of art which would enrich the knowledge of mankind, but only performs an existing work of art, making the societal benefit of an authors' work greater. The author therefore opposes the notion that Art. 34(1) of the Czech Charter of Fundamental Rights and Freedoms can be applied to artistic performances. Nevertheless, the protection of artistic performances is necessary because the society does not need only the existence of authors' creations, but also needs the art to be performed, if live art is to exist at all.
