Příležitost dělá zloděje: zkoumání praktického využití teorie příležitosti k trestné činnosti

Abstract

Teorie příležitosti k trestné činnosti je založena na třech dílčích konceptech. Prvním konceptem je teorie běžné činnosti, která pracuje s potencionálním pachatelem, vhodným objektem a schopným ochráncem. Příležitost k trestnému činu nastává ve chvíli, kdy dojde ke střetnutí pachatele s objektem bez schopného ochránce. Druhým konceptem je teorie racionální volby, ve které pachatel porovnává výši zisku z trestného činu s mírou rizika svého dopadení. Třetí koncept, teorie struktury trestné činnosti, poukazuje na důležitost času a prostředí trestných činů. Diplomová práce je zaměřena na prokázání použitelnosti teorie příležitosti k trestné činnosti, která je téměř čtyřicet let stará, v kontextu dnešní společnosti. Z tohoto důvodu je práce zaměřena na problematiku kyberkriminality, neboť některé trestné činy se z ulic přesouvají právě na internet. Pachatelé v kyberprostoru zvažují zisk a riziko obdobně jako pachatelé ve fyzickém prostředí. Objekty mají v kyberprostoru podobné vlastnosti jako objekty v reálném prostředí. Odlišným znakem mezi oběma světy je především ochránce, který se v kyberprostoru nevyskytuje náhodně, jak je tomu v reálném prostředí, ale je všudypřítomný. The opportunity theory for crime is composed of three partial concepts. The first concept is the routine activity theory that works with a potential offender, a suitable target and a capable guardian. The opportunity for crime occurs in the moment when the offender faces the target while guardians are absent. The second concept, the rational choice perspective, is based on the idea that the offender considers benefit and risk stemming from the crime. The third concept is the crime pattern theory that focuses on the importance of time and space. This master thesis focuses on the usability of the opportunity theory for crime in the context of our current society. Although the opportunity theory for crime is nearly forty years old, this work shows that it is also applicable on cybercrime since some of the "classical" crimes moved from physical space to cyberspace. The potential offender and suitable target exist and behave similarly in cyberspace and in physical space. The difference between the two worlds is notable for the capable guardian, who does not occur randomly in the cyberspace but is embodied in the form of ever-present protection.
