Zásah do integrity člověka

Abstract

Tělesná a duševní integrita člověka představuje jednu ze složek osobnosti lidské bytosti, kterou je možné chápat jako osobní sféru každého člověka a která je právním řádem chráněna před jakýmkoliv neoprávněným zásahem. Právní úprava zásahu do integrity člověka vychází z principu nedotknutelnosti lidské bytosti, podle něhož nesmí nikdo zasáhnout do integrity jiného bez jeho souhlasu, s výjimkou případů stanovených zákonem. Souhlas dotčené osoby je tak základní okolností vylučující protiprávnost zásahu. Tato diplomová práce si klade za cíl analyzovat současnou právní úpravu zásahu do integrity člověka obsaženou především v novém občanském zákoníku a poukázat na její případné nedostatky či problematické body. Zaměřuje se na jednotlivé okolnosti, za nichž je možné do integrity člověka zasáhnout, respektive které zásah odůvodňují, a vylučují tak jeho protiprávnost. Ačkoliv je práce vedena snahou zpracovat danou problematiku z pohledu občanského práva, s ohledem na skutečnost, že k naprosté většině závažnějších zásahů do integrity člověka dochází v rámci poskytování zdravotních služeb, neobejde se tato práce bez přihlédnutí k zvláštní právní úpravě v oblasti zdravotnictví. Physical and mental integrity of an individual represents one of the components of a human personality, which may be regarded as a personal sphere of everyone and which is protected by the law against any unauthorized interference. Legislation regarding the interference with the integrity of an individual is based on the principle of inviolability of a human being, according to which no one is entitled to interfere with the integrity of another individual without his consent, except as provided by law. The consent of the individual concerned is therefore the most fundamental circumstance excluding illegality of the interference. The aim of this diploma thesis is to analyse current legislation regarding the interference with the integrity of an individual, especially relevant provisions of the new civil code, and to point out its potential deficiencies or problematic aspects. It focuses on particular circumstances under which it is possible to interfere with the integrity of an individual, or which represent the reasons for such interference and therefore exclude its illegality.
