Abstract

Sociální zabezpečení osob se zdravotním postižením Tato práce pojednává o sociálním zabezpečení osob se zdravotním postižením. Cílem této práce je analýza právní úpravy platné a účinné na území České republiky a její uplatňování v praxi. Práce se skládá z šesti kapitol. Kapitola první si klade za cíl objasnit pojmy, jež jsou nezbytné k pochopení problematiky sociálního zabezpečení zdravotně postižených osob a s nimiž bude pracováno v dalších kapitolách této práce. Druhá kapitola se věnuje právním pramenům, ve kterých lze nalézt sociální zabezpečení osob se zdravotním postižením. Pozornost se zaměřuje především na právní předpisy práva mezinárodního, vnitrostátního a primárního práva Evropské unie. Třetí kapitola si klade za cíl popsat sociální zabezpečení osob se zdravotním postižením v rámci zákona o důchodovém pojištění. Obsahem této kapitoly je podrobný popis jednotlivých stupňů invalidního důchodu a popis posuzování zdravotního stavu pro účely zákona o důchodovém pojištění. Opomenuty nezůstávají ani otázky řízení a organizačního zajištění důchodového pojištění. Čtvrtá kapitola pojednává o nepojistných sociálních dávkách určených pouze osobám se zdravotním postižením. Social security of people with disabilities The thesis deals with social security of people with disabilities. Its aim is to analyse the legislation valid for the Czech republic and its implementation in real life situations. The thesis consists of six chapters. The first chapter aims to clarify basic terminology necessary to fully understand issues of social security of people with disabilities that will be used throughout the thesis. The second chapter is devoted to legal sources, that deal with social security of people with disabilities focused on provisions of international law, national and European Union law. The third chapter describes social security of people with disabilities within the realms of "Pension Insurance Act". It discusses various levels of disability pensions and the proces of health assesment in detail. Issues of management and further organization of pension insurance.
