Problematika omisivních deliktů v trestním právu

Abstract

This thesis deals with the issue of offences of omission within the criminal law. The existence of criminal liability for a lawless act obviously seems to be a reality. To be able to understand the lawless act consequence it is necessary to understand omission which is one of forms of the act an offender may commit. The first chapter is an introductioction. The second chapter shows the historical glance at the development of offence of omission. The third chapter, the most extensive, is dedicated to the current legal regulation of offences of omission found in Act No. 40/2009 Coll., the Criminal Code. The fourth chapter of this work provides comparing legal regulations of offences of omission in Great Britain and Germany and Czech version. The fifth chapter discusses the considerations de lege ferenda and the last chapter six is the conclusion.

Tato rigorózní práce je zaměřena na problematiku omisivních deliktů v trestním právu. Existence trestní odpovědnosti za protiprávní jednání je zcela zřejmou skutečností. Aby bylo možné pochopit závažnost protiprávního jednání, je třeba porozumět opomenutí, které je jednou z forem jednání, jehož se pachatel může dopustit. První kapitola je úvodem této práce. Druhá kapitola pojednává o historickém vývoji tohoto institutu. Třetí kapitola, která je nejrozsáhlejší se zaměřuje na současnou právní úpravu opomenutí zakotvenou v zákoně č. 40/2009 Sb., trestní zákoník. Čtvrtá kapitola poskytuje porovnání české úpravy opomenutí s úpravou ve Spojeném království Velké Británie a Severního Irska a také s úpravou německou. Pátá kapitola se zabývá úvahami de lege ferenda a poslední část této práce tvoří závěr.
