Doménová jména v českém právním prostředí

Abstract

Shrnutí Doménová jména v českém právním prostředí Cílem této práce je uvést čtenáře do problematiky doménových jmen jako takových s nezbytným technickým přesahem, jejich právní úpravy v českém právním řádu včetně obecného rozboru jednotlivých institutů práv na označení, které bývají pro jejich ochranu používány (konkrétně ochranných známek, nekalé soutěže, jména člověka a názvu právnické osoby), a konečně nastínit způsoby a vývoj řešení sporů z nich vzniklých před soudními i mimosoudními orgány. První kapitola práce pojednává o pojmu doménových jmen jako takového z technického hlediska. Popisuje funkci doménového jména v síti Internet a systém doménových jmen, tvořený doménami nejvyššího řádu různých druhů se svými specifiky. Následně se přes nástin registrace domén věnuje sporům z doménových jmen v globálním kontextu, včetně jednotlivých příčin (typů) těchto sporů, kde končí popisem specifické formy řešení těchto sporů, zvané UDRP. Druhá, nejobsáhlejší kapitola se věnuje právní úpravě doménových jmen v českém právní řádu samotné. Začíná jejich teoretickým pojetím a historickým vývojem úpravy, s akcentem na jednotlivé názorové náhledy na jejich uchopení. Domain names in the Czech legal system The aim of this work is to introduce readers to the topic of domain names themselves with a necessary technical overlap, their legal regulation in the Czech legal framework, including a general analysis of particular legal institutes used for their protection (namely trademarks, unfair competition, name of an individual and name of a legal entity), and finally to outline the ways and development of the settlement of disputes arising from them before the judicial and extrajudicial bodies. The first chapter of the thesis covers the concept of domain names as such from a technical point of view. There is described the domain name function in the Internet and the domain name system as well, consisting of top level domains of different types with their specifics. Consequently are there through domain name registration covered domain name disputes in a global context, including the individual causes (types) of these disputes, and finally concludes with the description of a specific form of alternative dispute resolution called UDRP.
